General Terms & Conditions (GTC / AGB)
Effective Date: 1 April, 2026
§ 1 Scope of Application
These General Terms and Conditions apply to all business relations between ENSOOL ("Contractor") and its clients ("Client"), specifically regarding the planning, engineering, and construction of photovoltaic systems.
§ 2 Contract Formation
Our offers for utility-scale solar projects are subject to change and non-binding unless explicitly stated otherwise. A contract is only formed upon our written order confirmation or the signing of an EPC agreement.
§ 3 Technical Execution & Standards
As a Professional Company, we commit to execution according to the current state of technology. The Client is responsible for providing accurate topographic and geotechnical data unless site analysis is specifically contracted to ENSOOL.
§ 4 Liability & Warranty
The warranty period for construction services is 2 years (BGB) or 5 years (VOB/B) if specifically agreed. Liability for minor negligence is excluded unless it concerns essential contractual obligations.
§ 5 Jurisdiction
The place of jurisdiction for all disputes arising from this contract is Dubai, VAE, provided the Client is a merchant or a legal entity under public law.
